Most DUIs and other driving offenses in Colorado are classified as Misdemeanors. Unless you are in custody, first appearances on Misdemeanor DUI cases in Adams County Colorado Courts occur in the First Appearance Center, AKA Division R. (If the defendant is in custody, the Sheriff will bring them to court for their first appearance, usually within 72 hours.) Division R is on the second floor of the Court House and may be accessed via the Elevators or the stairs just past the reception area. During your first appearance you will be asked to sign a copy of your legal rights. This is only to acknowledge that you receive the document and is neither a waiver of rights nor a confession of guilt. If you don't understand your rights or have questions you should consult an attorney ASAP.
Next you will be assigned to a staff DA who may make you an initial offer. These staff DAs usually do not have authority to negotiate your case, so plea negotiations or any discussions about the facts of the case are not recommended at this time. Your case will then be reset to a trial court for further proceedings. You should return for court on the next date that the clerk will give you.
First Appearances on Felony cases are handled a little differently. Felonies can subject you to much more severe penalties including up to several years in Prison. For this reason, these cases, including Felony DUI cases, are handled with more formality. If you are Being held in the Adams County Jail, you will be brought before a Judge who will advise you of your rights and who will usually set a bail bond amount that if paid to the Court or posted by a bail bondsman will allow you to get out of jail pending trial. A bond will include restrictions such as sobriety monitoring and travel restrictions.
You may be granted on a Personal Recognizance (PR) Bond, however this is less likely if you are charged with Felony DUI, Vehicular Assault or Vehicular Homicide. Finally, if you have not already received a copy of the charges against you, the matter will be set for filing of charges and a pre-trial conference with the DA's Office.
